Tommy Tuberville
Thomas Hawley Tuberville ( ; born September 18, 1954) is an American retired college football coach and politician serving as the junior United States senator from Alabama since 2021. Before entering politics, Tuberville was the head football coach at Auburn University from 1999 to 2008. He was also the head football coach at the University of Mississippi from 1995 to 1998, Texas Tech University from 2010 to 2012, and the University of Cincinnati from 2013 to 2016. Tuberville received the 2004 Walter Camp and Bear Bryant Coach of the Year awards after Auburn's 13–0 season, in which Auburn won the Southeastern Conference title and the Sugar Bowl, but was left out of the BCS National Championship Game. He earned his 100th career win in 2007. Tuberville is the only coach in Auburn football history to beat in-state rival Alabama six consecutive times. ''Tuberville v Savage'' (1669) 1 Mod Rep 3; 86 ER 684 is an English decision about the requirements for both the tort of assault (tort), assault and the common law criminal offence of common assault. It involved plaintiff Tuberville versus defendant Savage. The court held that a conditional threatening statement, without an imminent threat of harm, does not constitute an assault. Facts Savage had made some insulting comments to Tuberville. In response, Tuberville grabbed the handle of his sword and stated, "If it were not assize-time, I would not take such language from you." Savage responded with force, causing Tuberville to lose his eye. Tuberville brought an action for assault, battery, and wounding, to which Savage pleaded provocation, to-wit Tuberville's statement. Judgment The Court considered the language used in the statement and found that Tuberville did not express any intention to do any harm to Savage in the given circumstances.
