Second Railway Package
The Second Railway Package is a group of European Union legislation which promote common standards and open access, working towards an integrated European railway area. History For much of the 20th century, rail transport in Europe was dominated by national monopolies; these effectively excluded competitors from their networks. Starting in 1991, the EU developed legislation to open railways up to competition, which would help them regain modal share from road and air transport. Legislation Directive 2004/49/EC 2004/49/EC is the Railway Safety Directive; it has since been amended by Directive 2008/110/EC. It harmonised safety principles, including procedures for granting safety approval to railway operators and infrastructure owners. European Union Legislation
A directive is a legal act of the European Union that requires member states to achieve a particular result without dictating the means of achieving that result. Directives first have to be enacted into national law by member states before their laws are ruling on individuals residing in their countries. Directives normally leave member states with a certain amount of leeway as to the exact rules to be adopted. Directives can be adopted by means of a variety of legislative procedures depending on their subject matter. The text of a draft directive (if subject to the co-decision process, as contentious matters usually are) is prepared by the Commission after consultation with its own and national experts. Open Access (infrastructure)
In the context of infrastructure, open access involves physical infrastructure such as railways and physical telecommunications network plants being made available to clients other than owners, for a fee. For example, private railways within a steel works are private and not available to outsiders. In the hypothetical case of the steelworks having a port or a railway to a distant mine, outsiders might want access to save having to incur a possibly large cost of building their own facility. A modal share (also called mode split, mode-share, or modal split) is the percentage of travelers using a particular type of transportation or number of trips using said type. In freight transportation, this may be measured in mass. Modal share is an important component in developing sustainable transport within a city or region. In recent years, many cities have set modal share targets for balanced and sustainable transport modes, particularly 30% of non-motorized (cycling and walking) and 30% of public transport. European Railway Agency
The European Union Agency for Railways (ERA) is an Agencies of the European Union, agency of the European Union (EU) that sets mandatory requirements for European railways and manufacturers in the form of Technical Specifications for Interoperability (TSI), which apply to the Trans-European Rail system. The ERA publishes a document summarising the status of the TSIs. The ERA sets common safety targets, common safety methods and common safety indicators, following Directive 2004/49/EC and amendments. The ERA also hosts a number of databases, among which a register of remaining, applicable national rules. History The agency was established in 2004 as part of the Second Railway Package, and commenced operations in 2006 as the European Railway Agency (ERA). EU Directive 91/440
The Single European Railway Directive 2012''2012/34/EUis an EU Directive that regulates railway networks in European Union law. This recast the "First Railway Directive" or "Package" from 1991, and allows open access operations on railway lines by companies other than those that own the rail infrastructure. The legislation was extended by further directives to include cross border transit of freight. In September 2010, the process of merging the directives into a single piece of legislation was begun, with the addition of modifications to strengthen the regulatory framework. The European Rail Traffic Management System (ERTMS) is the system of standards for management and interoperation of signalling for railways by the European Union (EU). Fourth Railway Package
The fourth railway package is a set of changes to rail transport regulation in the European Union law. It covers standards and authorisation for rolling stock; workforce skills; independent management of infrastructure; and the liberalisation of domestic passenger services in an attempt to reduce European rail subsidies. Background The fourth railway package attempts to reform railways companies (whether private or public) that are able to raise prices if they dominate both tracks and the trains.
