Suicide Legislation
Suicide is a crime in some parts of the world. However, while suicide has been decriminalized in many western countries, the act is stigmatized and discouraged. In other contexts, suicide could be utilized as an extreme expression of liberty, as is exemplified by its usage as an expression of devout dissent towards perceived tyranny or injustice which occurred occasionally in cultures like ancient Rome, medieval Japan, or today's Chinese Tibet. While a person who has died of suicide is beyond the reach of the law, there can still be legal consequences in relation to treatment of the corpse or the fate of the person's property or family members. The associated matters of assisting a suicide and attempting suicide have also been dealt with by the laws of some jurisdictions. Some countries criminalise suicide attempts. History In ancient Athens, a person who had died of suicide (without the approval of the state) was denied the honours of a normal burial. The person would be bu ... Section 309 states: : Whoever attempts to commit suicide and does any act towards the commission of such offence, shall be punished with simple imprisonment for a term which may extend to one year or with fine, or with both. Although section 309 is still in effect, the Mental Healthcare Act, 2017 (enacted July 2018) has restricted its application. The relevant provision of the new act states: : Notwithstanding anything contained in section 309 of the Indian Penal Code, any person who attempts to commit suicide shall be presumed, unless proved otherwise, to have severe stress and shall not be tried and punished under the said Code. Path to repeal In the 1996 ''Gian Kaur vs State of Punjab'', the appellant failed to convince the five judge bench that section 309 violated article 21 of the Constitution of India. A bill to strike the section was subsequently introduced in parliament, b ... [...More Info...]       [...Related Items...]     OR:     [Wikipedia]   [Google]   [Baidu]   |

Incitement
In criminal law, incitement is the encouragement of another person to commit a crime. Depending on the jurisdiction, some or all types of incitement may be illegal. Where illegal, it is known as an inchoate offense, where harm is intended but may or may not have actually occurred. International law *The Article 20 of the International Covenant on Civil and Political Rights requires that any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law. That few journalists have been prosecuted for incitement to genocide and war crimes despite their recruitment by governments as propagandists is explained by the relatively privileged social status of journalists and privileged institutional position of news organizations in liberal societies, which assign a high value to a free press. England and Wales Incitement was an offence under the common law of England and Wales. It was an inchoate offenc ... Murder
Murder is the unlawful killing of another human without justification or valid excuse, especially the unlawful killing of another human with malice aforethought. ("The killing of another person without justification or excuse, especially the crime of killing a person with malice aforethought or with recklessness manifesting extreme indifference to the value of human life.") This state of mind may, depending upon the jurisdiction, distinguish murder from other forms of unlawful homicide, such as manslaughter. Manslaughter is killing committed in the absence of ''malice'',This is "malice" in a technical legal sense, not the more usual English sense denoting an emotional state. See malice (law). brought about by reasonable provocation, or diminished capacity. ''Involuntary'' manslaughter, where it is recognized, is a killing that lacks all but the most attenuated guilty intent, recklessness. Most societies consider murder to be an extremely serious crime, and thus that ... [...More Info...]       [...Related Items...]     OR:     [Wikipedia]   [Google]   [Baidu]   |

Manslaughter
Manslaughter is a common law legal term for homicide considered by law as less culpable than murder. The distinction between murder and manslaughter is sometimes said to have first been made by the ancient Athenian lawmaker Draco in the 7th century BC. The definition of manslaughter differs among legal jurisdictions. Types Voluntary In voluntary manslaughter, the offender had intent to kill or seriously harm, but acted "in the moment" under circumstances that could cause a reasonable person to become emotionally or mentally disturbed. There are mitigating circumstances that reduce culpability, such as when the defendant kills only with an intent to cause serious bodily harm. Voluntary manslaughter in some jurisdictions is a lesser included offense of murder. The traditional mitigating factor was provocation; however, others have been added in various jurisdictions. The most common type of voluntary manslaughter occurs when a defendant is provoked to commit homicide. This ... Suicide Pact
A suicide pact is an agreed plan between two or more individuals to die by suicide. The plan may be to die together, or separately and closely timed. General considerations Suicide pacts are an important concept in the study of suicide, and have occurred throughout history, as well as in fiction. An example of this is the suicide pact between Rudolf, Crown Prince of Austria and Baroness Mary Vetsera. Suicide pacts are sometimes contrasted with mass suicides, understood as incidents in which a larger number of people kill themselves together for the same ideological reason, often within a religious, political, military or paramilitary context. "Suicide pact" tends to connote small groups and non-ideological motivations, as do bonding as married or romantic partners, as family members or friends, or even as criminal partners. Legal aspects In England and Wales, suicide pact is a partial defense, under section 4 of the Homicide Act 1957, which reduces murder to manslaughter ...
