Rompilla V. Beard
''Rompilla v. Beard'', , is a case decided by the Supreme Court of the United States on June 20, 2005. In a majority opinion authored by Justice David Souter, the Court held 5–4 that the petitioner, convicted murderer Ronald Rompilla, had received ineffective assistance of counsel due to his lawyer's failure to adequately investigate and obtain evidence that the lawyer knew the prosecution would likely use against the defendant. It therefore reversed the prior ruling to the contrary by the United States Court of Appeals for the Third Circuit, and overturned Rompilla's death sentence as a result. It was the third major case in five years in which the Supreme Court had invalidated a death sentence on the grounds that the defendant had received ineffective assistance of counsel. The Pennsylvania Department of Corrections (PADOC) is the Pennsylvania state agency that is responsible for the confinement, care and rehabilitation of approximately 37,000 inmates at state correctional facilities funded by the Commonwealth of Pennsylvania. The agency has its headquarters in Hampden Township, Cumberland County in Greater Harrisburg, near Mechanicsburg. In October 2017, Gov. Tom Wolf signed a "memorandum of understanding" that allows the PADOC and the Pennsylvania Board of Probation and Parole to share like resources and eliminate duplicative efforts. All parole supervision now falls under the jurisdiction of the PADOC; while parole release decisions remain under the jurisdiction of the PA Board of Probation and Parole. David Hackett Souter ( ; born September 17, 1939) is an American lawyer and jurist who served as an associate justice of the U.S. Supreme Court from 1990 until his retirement in 2009. Appointed by President George H. W. Bush to fill the seat that had been vacated by William J. Brennan Jr., Souter sat on both the Rehnquist and the Roberts courts. Souter grew up in Massachusetts and New Hampshire and attended Harvard College, Magdalen College, Oxford, and Harvard Law School. In United States law, ineffective assistance of counsel (IAC) is a claim raised by a convicted criminal defendant asserting that the defendant's legal counsel performed so ineffectively that it deprived the defendant of the constitutional right guaranteed by the Assistance of Counsel Clause of the Sixth Amendment to the United States Constitution. Ineffectiveness claims may only be brought where the defendant had the right to counsel, ordinarily during the critical stages of a prosecution. Sandra Day O'Connor
Sandra Day O'Connor (born March 26, 1930) is an American retired attorney and politician who served as the first female associate justice of the Supreme Court of the United States from 1981 to 2006. She was both the first woman nominated and the first confirmed to the court.
