Michael Townley Featherstone Briggs, Lord Briggs of Westbourne, (born 23 December 1954) is a Justice of the Supreme Court of the United Kingdom. He served earlier as a judge of the Court of Appeal of England and Wales. By Royal Warrant, he bears the courtesy title of Lord Briggs of Westbourne. Education He was educated at Charterhouse School and Magdalen College, Oxford. Legal career Michael Briggs was called to the bar at Lincoln's Inn in 1978 and was the Junior Counsel to Crown Chancery from 1990-94. He became a Queen's Counsel in 1994. He was made a Bencher of Lincoln's Inn in 2001, and was appointed Attorney General of the Duchy of Lancaster on 24 July of that year. He held the post until shortly after his appointment to the High Court. United Kingdom insolvency law regulates companies in the United Kingdom which are unable to repay their debts. While UK bankruptcy law concerns the rules for natural persons, the term insolvency is generally used for companies formed under the Companies Act 2006. "Insolvency" means being unable to pay debts. Since the Cork Report of 1982, the modern policy of UK insolvency law has been to attempt to rescue a company that is in difficulty, to minimise losses and fairly distribute the burdens between the community, employees, creditors and other stakeholders that result from enterprise failure. If a company cannot be saved it is "liquidated", so that the assets are sold off to repay creditors according to their priority. A structured investment vehicle (SIV) is a non-bank financial institution established to earn a credit spread between the longer-term assets held in its portfolio and the shorter-term liabilities it issues. They are simple credit spread lenders, frequently "lending" by investing in securitizations, but also by investing in corporate bonds and funding by issuing commercial paper and medium term notes, which were usually rated AAA until the onset of the financial crisis. They did not expose themselves to either interest rate or currency risk and typically held asset to maturity. SIVs differ from asset-backed securities and collateralized debt obligations (CDOs) in that they are permanently capitalized and have an active management team.
