Recognition Of Same-sex Unions In Albania
Same-sex unions are not currently recognized in Albania, whether in the form of marriage or civil unions. Legal history Prime Minister Sali Berisha announced in a cabinet meeting on 29 July 2009 that the Council of Ministers would push for a bill to recognise marriages between partners of the same sex. He said that the bill had already been introduced to the Parliament of Albania. On 5 February 2010, the Albanian Parliament passed an anti-discrimination law banning discrimination on the grounds of sexual orientation. Gay rights groups praised the new law but said they hoped that Berisha would eventually keep his promise on legalising same-sex marriage. European Commission Against Racism And Intolerance
European Commission against Racism and Intolerance (ECRI) is the Council of Europe’s independent human rights monitoring body specialised in combating antisemitism, discrimination, racism, religious intolerance, and xenophobia. It publishes periodic reports on CoE member states and general policy recommendations. The decision to found ECRI was adopted in 1993. The organization became officially active as of March 1994. Xheni Karaj (born in Tirana) is an Albanian LGBT rights activist, and co-founder and current executive of Aleanca LGBT organization. Political activism Karaj and LGBT-activist Kristi Pinderi were among the first activists to launch the LGBT rights movement in Albania. Kristi Pinderi (born August 2, 1982, Pogradec) is an Albanian activist advocating for LGBT community rights and a freelance journalist resident in Canada. He is the founder of the Pro-LGBT organization in Albania. Political activism Kristi Pinderi, known in Albania as a LGBT rights activist, has fled Albania, and lives in Canada. He came out to his family at the age of 27. In March 2012, he established Pro-LGBT, an organisation that works mainly to raise awareness about LGBT topics. Positive obligations in human rights law denote a State's obligation to engage in an activity to secure the effective enjoyment of a fundamental right, as opposed to the classical negative obligation to merely abstain from human rights violations. Classical human rights, such as the right to life or freedom of expression, are formulated or understood as prohibitions for the State to act in a way that would violate these rights. Thus, they would imply an obligation for the State not to kill, or an obligation for the State not to impose press censorship.
