People V. Aguilar
''People v. Aguilar'', 2 N.E.3d 321 (Ill. 2013), was an Illinois Supreme Court case in which the Court held that the Aggravated Unlawful Use of a Weapon (AUUF) statute violated the right to keep and bear arms as guaranteed by the Second Amendment. The Court stated that this was because the statute amounted to a wholesale statutory ban on the exercise of a personal right that was specifically named in and guaranteed by the United States Constitution, as construed by the United States Supreme Court. A conviction for Unlawful Possession of a Firearm (UPF) was proper because the possession of handguns by minors was conduct that fell outside the scope of the Second Amendment's protection. In 2008, Alberto Aguilar, then 17, was arrested and charged with AUUF and UPF. The Supreme Court of Illinois is the state supreme court, the highest court of the State of Illinois. Oak Park, Illinois
Oak Park is a village in Cook County, Illinois, adjacent to Chicago. It is the 29th-most populous municipality in Illinois with a population of 54,583 as of the 2020 U.S. Census estimate. Oak Park was first settled in 1835 and later incorporated in 1902, when it separated from Cicero, Illinois, Cicero. Architect Frank Lloyd Wright and his wife settled in Oak Park in 1889, and his work heavily influenced local architecture and design, including the Frank Lloyd Wright Home and Studio. Intermediate scrutiny, in U.S. constitutional law, is the second level of deciding issues using judicial review. The other levels are typically referred to as rational basis review (least rigorous) and strict scrutiny (most rigorous). In order to overcome the intermediate scrutiny test, it must be shown that the law or policy being challenged furthers an ''important'' government interest by means that are substantially related to that interest.
