This is a list of Supreme Court of the United States cases in the area of copyright law. In the United States Constitution, the Copyright Clause in Article 1, Section 8 endows Congress with the power to create a copyright system. To avoid individual states' attempts at creating their own copyright systems, Congress passed the Copyright Act of 1790, based on Great Britain's Statute of Anne. Over the decades since, copyright in the United States has become a more complicated system with longer terms and more tests, and has been the subject of many decisions by the Court. The Supreme Court was the source of a number of concepts in the field, including fair use, the idea-expression divide, the useful articles or separability doctrine, and the uncopyrightability of federal documents. Supreme Court Of The United States
The Supreme Court of the United States (SCOTUS) is the highest court in the federal judiciary of the United States. It has ultimate appellate jurisdiction over all U.S. federal court cases, and over state court cases that involve a point of federal law. It also has original jurisdiction over a narrow range of cases, specifically "all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party." The court holds the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution. It is also able to strike down presidential directives for violating either the Constitution or statutory law. However, it may act only within the context of a case in an area of law over which it has jurisdiction. Morrison Waite
Morrison Remick "Mott" Waite (November 29, 1816 – March 23, 1888) was an American attorney, jurist, and politician from Ohio. He served as the seventh chief justice of the United States from 1874 until his death in 1888. During his tenure, the Waite Court took a narrow interpretation of federal authority related to laws and amendments that were enacted during the Reconstruction Era to expand the rights of freedmen and protect them from attacks by white-supremacy groups such as the Ku Klux Klan. Born in Lyme, Connecticut, Waite established a legal practice in Toledo, Ohio after graduating from Yale University. As a member of the Whig Party, Waite won election to the Ohio Senate. Perris is an old railway city in Riverside County, California, United States, located east-southeast of Los Angeles and north of San Diego. It is known for Lake Perris, an artificial lake, skydiving, and its sunny dry climate. Perris is within the Inland Empire metropolitan area of Southern California. Perris had a population of 78,700 as of the 2020 census. History The coming of the California Southern Railroad led to the founding of the city around the new depot, on the rail connection between the present-day cities of Barstow and San Diego. The Perris Depot is included in the Library of Congress’ Historic American Buildings Survey. David Davis (Supreme Court Justice)
David Davis (March 9, 1815 – June 26, 1886) was an American politician and jurist who was a U.S. senator from Illinois and associate justice of the United States Supreme Court. He also served as Abraham Lincoln's campaign manager at the 1860 Republican National Convention, engineering Lincoln's successful nomination for president by that party. Of wealthy Maryland birth, Davis was educated at Kenyon College and Yale University, before settling in Bloomington, Illinois in the 1830s, where he practiced law. He served in the Illinois legislature and as a delegate to the state constitutional convention before becoming a state judge in 1848. Shortly after Lincoln won the presidency he appointed the determinedly independent Davis to the United States Supreme Court, where he served until 1877. Copyright Renewal In The United States
Copyright renewal is a copyright formality through which an initial term of copyright protection for a work can be extended for a second term. Once the term of copyright protection has ended, the copyrighted work enters the public domain, and can be freely reproduced and incorporated into new works. In the United States, works published before are all in the public domain under the provisions of the Copyright Act of 1909 and previous law. This act provided for an initial term of 28 years. This term could be extended for an additional 28 years by registering copyright renewal with the United States Copyright Office. Works published before 1964 in the US are all in the public domain, excepting only those for which a renewal was registered with the US Copyright Office. Equity is a particular body of law that was developed in the English Court of Chancery. Its general purpose is to provide a remedy for situations where the law is not flexible enough for the usual court system to deliver a fair resolution to a case. The concept of equity is deeply intertwined with its historical origins in the common law system used in England. However, equity is in some ways a separate system from common law: it has its own established rules and principles, and was historically administered by separate courts, called " courts of equity" or "courts of chancery". Equity exists in domestic law, both in civil law and in common law systems, and in international law. Samuel Nelson
Samuel Nelson (November 10, 1792 – December 13, 1873) was an American attorney and appointed as judge of New York State courts. He was appointed as a Justice of the Supreme Court of the United States, serving from 1845 to 1872. He concurred on the 1857 ''Dred Scott'' decision, although for reasons different from Chief Justice Taney's. Early life Nelson was born in Hebron, New York on November 10, 1792, the son of Scotch-Irish immigrants John Rodgers Nelson and his wife Jean McArthur. Nelson's family was upper middle class, with a prosperous family farm. Nelson was educated in the public schools of Hebron, with an additional three years in private schooling for college preparation. He entered Middlebury College in Vermont.
