Leandra's Law
Leandra's Law (Child Passenger Protection Act) is a New York State law making it an automatic felony on the first offense to drive drunk with a person age 15 or younger inside the vehicle, and setting the blood alcohol content, or BAC, at 0.08. The bill was unanimously passed by the New York State Assembly and the New York State Senate and then signed into law by Governor David Paterson on November 18, 2009. Background Leandra Rosado, an 11-year-old girl, was killed on the Henry Hudson Parkway in New York City on October 11, 2009 when her friend's mother, Carmen Huertas, lost control of the car they were in while allegedly under the influence of alcohol. Felony
A felony is traditionally considered a crime of high seriousness, whereas a misdemeanor is regarded as less serious. Blood alcohol content (BAC), also called blood alcohol concentration or blood alcohol level, is a measurement of alcohol intoxication used for legal or medical purposes; it is expressed as mass of alcohol per volume or mass of blood. For example, a BAC of 0.10 by (0.10% or one tenth of one percent) means that there is 0.10 g of alcohol for every 100 mL of blood, which is the same as 21.7 mmol/L. The New York State Assembly is the lower house of the New York State Legislature, with the New York State Senate being the upper house. There are 150 seats in the Assembly. New York State Senate
The New York State Senate is the upper house of the New York State Legislature; the New York State Assembly is its lower house. Its members are elected to two-year terms; there are no term limits. There are 63 seats in the Senate. Partisan composition The New York State Senate was dominated by the Republican Party for much of the 20th century. David Paterson
David Alexander Paterson (born May 20, 1954) is an American politician and attorney who served as the 55th governor of New York, succeeding Eliot Spitzer and serving out nearly three years of Spitzer's term from March 2008 to December 2010. Henry Hudson Parkway
The Henry Hudson Parkway is a parkway in New York City. The southern terminus is in Manhattan at 72nd Street, where the parkway continues south as the West Side Highway. It is often erroneously referred to as the West Side Highway throughout its entire course in Manhattan. 2009 Taconic State Parkway Crash
The 2009 Taconic State Parkway crash was a traffic collision that occurred shortly after on Sunday, July 26, 2009, on the Taconic State Parkway in the town of Mount Pleasant, New York, Mount Pleasant, near the village of Briarcliff Manor, New York, United States. Eight people were killed when a minivan, being driven by 36-year-old Diane Schuler, traveled in the wrong direction on the parkway and collided head-on with an oncoming SUV. Ignition Interlock Device
An ignition interlock device or breath alcohol ignition interlock device (IID or BAIID) is a breathalyzer for an individual's vehicle. It requires the driver to blow into a mouthpiece on the device before starting or continuing to operate the vehicle. If the resultant breath-alcohol concentration analyzed result is greater than the programmed blood alcohol concentration (which varies between countries), the device prevents the engine from being started. The interlock device is located inside the vehicle, near the driver’s seat, and is directly connected to the engine’s ignition system. It is a form of electronic monitoring. An ignition interlock interrupts the signal from the ignition to the starter until a valid breath sample is provided that meets maximal alcohol guidelines in that jurisdiction.
