Regulatory reform concerns improvements to the quality of government regulation. Delegated legislation or secondary legislation in the United Kingdom is law that is not enacted by a legislative assembly such as the UK Parliament, but made by a government minister, a delegated person or an authorised body under powers given to them by an Act of Parliament. Statutory Instruments are the most frequently used type of secondary legislation, with approximately 3,500 made each year, although only about 1,000 need to be considered by Parliament. They usually have either rule, order or regulation in their title. Secondary legislation is used for a wide variety of purposes such as fixing the date on which an Act of Parliament will come into force; setting fees for a public service; or establishing the details of an Act of Parliament. Delegated legislation is dependent on its parent act, which prescribes its parameters and procedures. Primary legislation and secondary legislation (the latter also called delegated legislation or subordinate legislation) are two forms of law, created respectively by the legislative and executive branches of governments in representative democracies. Primary legislation generally consists of statutes, also known as 'acts', that set out broad outlines and principles, but delegate specific authority to an executive branch to make more specific laws under the aegis of the principal act. Regulatory Reform Act 2001
The Regulatory Reform Act 2001 (c.6) is an Act of the Parliament of the United Kingdom. It replaced the Deregulation and Contracting Out Act 1994. It removed some of the constraints on Deregulation Orders under the 1994 Act, by providing wider powers for government ministers to make a Regulatory Reform Order by statutory instrument. The Act was introduced to the House of Lords on 7 December 2000, and passed to the House of Commons on 19 March 2001. It passed its Report Stage and Third Reading on 4 April 2001. Under the 2001 Act, a government minister can make a Regulatory Reform Order to " eformlegislation which has the effect of imposing burdens", with a view to removing or reducing the regulatory burdens. The Act can only be used to reform existing legislation, so cannot be used to codify the common law, and can only be used where burdens are removed (although, unlike the 1994 Act, new burdens can also be imposed where proportional). The Regulatory Reform (Fire Safety) Order 2005 (officially listed as ''The Regulatory Reform (Fire Safety) Order 2005 S.I. 2005 No. 1541'') is a statutory instrument applicable in England and Wales. The Order places the responsibility on individuals within an organisation to carry out risk assessments to identify, manage and reduce the risk of fire. The Order was made into law on 7 June 2005 and came into force on 1 October 2006. Guidance for businesses is available in the form of 16 government-published documents, with general guidance, a 5-Step Checklist and 12 documents pertaining specifically to a particular type of business premises. On 5 January 2016, responsibility for fire and rescue policy transferred from the Department for Communities and Local Government to the Home Office, who then became responsible for the guidance.
