Federal Court Of Australia
The Federal Court of Australia is an Australian superior court of record which has jurisdiction to deal with most civil disputes governed by federal law (with the exception of family law matters), along with some summary (less serious) and indictable (more serious) criminal matters. Cases are heard at first instance by single judges. The court includes an appeal division referred to as the Full Court comprising three judges, the only avenue of appeal from which lies to the High Court of Australia. In the Australian court hierarchy, the Federal Court occupies a position equivalent to the supreme courts of each of the states and territories. In relation to the other courts in the federal stream, it is superior to the Federal Circuit and Family Court of Australia for all jurisdictions except family law. ''ACCC v Cabcharge Australia Ltd'' is a 2010 decision of the Federal Court of Australia brought by the Australian Competition & Consumer Commission (ACCC) against Cabcharge.; . In June 2009, the ACCC began proceedings in the Federal Court against Cabcharge alleging that it had breached section 46 of the Commonwealth Trade Practices Act (TPA) by misusing its market power and entering into an agreement to substantially lessen competition. The action alleged predatory pricing by Cabcharge and centred on Cabcharge's conduct in refusing to deal with competing suppliers to allow Cabcharge payments to be processed through EFTPOS terminals provided by rival companies and supplying taxi meters and fare updates at below actual cost or at no cost. ''Barilaro v Shanks-Markovina & Google'' was a defamation court case before the Federal Court of Australia in 2021 and 2022. The case revolved around claims that two videos published on the friendlyjordies YouTube channel brought the then Deputy Premier of New South Wales, John Barilaro, into public disrepute, odium, ridicule and contempt. Barilaro resigned his seat of Electoral district of Monaro, Monaro citing this case being ongoing as a reason, causing a 2021 Monaro by-election, by-election in that seat. Barilaro originally filed the lawsuit against the first respondent, Jordan Shanks-Markovina, as the videos' author, and the second respondent, Google, as their publisher via its YouTube service. The case against Shanks-Markovina was settled in November 2021 with Shanks-Markovina apologising in court for allegedly offensive remarks made in the videos.
