Kalkines Warning
The ''Kalkines'' warning is an advisement of rights usually administered by United States federal government agents to federal employees and contractors in internal investigations. The ''Kalkines'' warning compels subjects to make statements or face disciplinary action up to, and including, dismissal, but also provides suspects with criminal immunity for their statements. It was promulgated by the U.S. Court of Federal Claims in '' Kalkines v. United States''.473 F2d 1391 (U.S. Court of Claims) (1973) In that case, a federal employee was fired for not cooperating with an internal investigation. The Court of Claims found that the employee had not been sufficiently advised of his immunity to criminal prosecution, nor sufficiently warned that he would be fired if he refused to cooperate. Garrity Warning
In United States law, the ''Garrity'' warning is an advisement of rights usually administered by federal, state, or local investigators to their employees who may be the subject of an internal investigation. The ''Garrity'' warning advises subjects of their criminal and administrative liability for any statements they may make, but also advises subjects of their right to remain silent on any issues that tend to implicate them in a crime. (See ''Kalkines'' warning concerning federal employees.) It was devised in response to the Supreme Court of the United States ruling in ''Garrity v. New Jersey'' (1967). In that case, a police officer was compelled to make a statement or be fired, and then criminally prosecuted for his statement. The Supreme Court found that the officer had been deprived of his Fifth Amendment right to silence. Miranda Warning
In the United States, the ''Miranda'' warning is a type of notification customarily given by police to criminal suspects in police custody (or in a custodial interrogation) advising them of their right to silence and, in effect, protection from self-incrimination; that is, their right to refuse to answer questions or provide information to law enforcement or other officials. These rights are often referred to as ''Miranda'' rights. The purpose of such notification is to preserve the admissibility of their statements made during custodial interrogation in later criminal proceedings. The idea came from law professor Yale Kamisar, who subsequently was dubbed "the father of ''Miranda''."
