Hudson V. McMillian
''Hudson v. McMillian'', 503 U.S. 1 (1992), is a United States Supreme Court decision where the Court on a 7—2 vote held that the use of excessive physical force against a prisoner may constitute cruel and unusual punishment even though the inmate does not suffer serious injury. Opinion of the Court Justice Sandra Day O'Connor delivered the opinion of the Court, joined by Chief Justice Rehnquist and Justices White, Kennedy, and Souter. Justices Blackmun and Stevens separately concurred in the judgment. In the case, petitioner Hudson, a Louisiana prison inmate, testified that he suffered minor bruises, facial swelling, loosened teeth, and a cracked dental plate as a result from a beating by respondent prison guards, McMillian and Woods, while he was handcuffed and shackled following an argument with McMillian, and that respondent Mezo, a supervisor on duty, allegedly watched the beating and told the officers "not to have too much fun." Cruel And Unusual Punishment Clause Case Law
Cruelty is the pleasure in inflicting suffering or inaction towards another's suffering when a clear remedy is readily available. Sadism can also be related to this form of action or concept. Cruel ways of inflicting suffering may involve violence, but affirmative violence is not necessary for an act to be cruel. For example, if a person is drowning and begging for help and another person is able to help with no cost or risk, but is merely watching with disinterest or perhaps mischievous amusement, that person is being cruel—rather than violent. John Marshall Harlan II
John Marshall Harlan (May 20, 1899 – December 29, 1971) was an American lawyer and jurist who served as an associate justice of the U.S. Supreme Court from 1955 to 1971. Harlan is usually called John Marshall Harlan II to distinguish him from his grandfather John Marshall Harlan, who served on the U.S. Supreme Court from 1877 to 1911. Harlan was a student at Upper Canada College and Appleby College and then at Princeton University. Awarded a Rhodes Scholarship, he studied law at Balliol College, Oxford. Upon his return to the U.S. in 1923 Harlan worked in the law firm of Root, Clark, Buckner & Howland while studying at New York Law School. Later he served as Assistant U.S. Attorney for the Southern District of New York and as Special Assistant Attorney General of New York. Felix Frankfurter
Felix Frankfurter (November 15, 1882 – February 22, 1965) was an Austrian-American jurist who served as an Associate Justice of the Supreme Court of the United States from 1939 until 1962, during which period he was a noted advocate of judicial restraint in its judgements. Frankfurter was born in Vienna, immigrating to New York City at the age of 12. After graduating from Harvard Law School, Frankfurter worked for Henry L. Stimson, the U.S. Secretary of War. During World War I, Frankfurter served as Judge Advocate General. After the war, he helped found the American Civil Liberties Union and returned to his position as a professor at Harvard Law School. He became a friend and adviser of President Franklin D. Roosevelt, who appointed him to fill the Supreme Court vacancy caused by the death of Benjamin N. Cardozo. David Garrow
David Jeffries Garrow (born May 11, 1953) is an American author and historian. He wrote the book ''Bearing the Cross: Martin Luther King, Jr., and the Southern Christian Leadership Conference'' (1986), which won the 1987 Pulitzer Prize for Biography. He also wrote ''Liberty and Sexuality'' (1994), a history of the legal struggles over abortion and reproductive rights in the U.S. prior to the 1973 ''Roe v. Wade'' decision, '' Rising Star: The Making of Barack Obama'' (2017), and other works. Professional historians and scholars in other fields have criticized Garrow's later work on Martin Luther King.
