''Hannegan v. Esquire, Inc.'', 327 U.S. 146 (1946), was a U.S. Supreme Court case argued between the United States Postal Service and ''Esquire'' magazine. In a unanimous decision, the Supreme Court ruled that the USPS was without statutory authority to revoke a periodical's second class permit on the basis of objectionable material that was not obscene.. Background ''Hannegan v. Esquire, Inc.'' was the culmination of a bitter legal battle between ''Esquire'' magazine and the USPS that began in 1943. Taking offense to the Varga Girl and other pin-up style imagery, Postmaster General Frank Comerford Walker convened a hearing board in October 1943 to determine whether ''Esquire'' contained obscenity. A host of national figures were called in as witnesses to offer their "expertise" on whether the Varga Girl and other ''Esquire'' content was obscene, among them H. L. Mencken and Rev. Joaquin Alberto Vargas y Chávez (9 February 1896 – 30 December 1982) was a Peruvian-American painter of pin-up girls. He is often considered one of the most famous of the pin-up artists. Numerous Vargas paintings have sold and continue to sell for hundreds of thousands of dollars. Life and career Born in Arequipa, Peru, he was the son of noted Peruvian photographer Max T. Vargas. Alberto Vargas moved to the United States in 1916 after studying art in Europe, particularly in Zurich and Geneva, prior to World War I. While he was in Europe he came upon the French magazine '' La Vie Parisienne,'' with a cover by Raphael Kirchner, which he said was a great influence on his work. His early career in New York included work as an artist for the Ziegfeld Follies and for many Hollywood studios. Robert Hannegan
Robert Emmet Hannegan (June 30, 1903 – October 6, 1949) was an American politician who served as Commissioner of Internal Revenue from October 1943 to January 1944. He also served as chairman of the Democratic National Committee from 1944 to 1947 and United States Postmaster General from 1945 to 1947. After his political career, in 1947, Hannegan and partner Fred Saigh purchased the St. Louis Cardinals of Major League Baseball. But Hannegan, ill with heart disease, sold his share in the team to Saigh a few months before his death. Frank Comerford Walker (May 30, 1886 – September 13, 1959) was an American lawyer and politician. He was the United States Postmaster General from 1940 until 1945, and the chairman of the Democratic National Committee from 1943 until 1944. Biography Frank Walker was born in Plymouth, Pennsylvania, the son of David Walker, a grocer, and his wife, Ellen Comerford, but moved with his family to Montana when he was four years old. He attended Gonzaga University in Spokane, Washington for three years and earned a law degree from Notre Dame in 1909. He then joined his older brother Thomas in a law practice in Butte, Montana. In 1913, he was elected to a term as a Montana state representative. During World War I, Walker volunteered for the U.S. Army. He became a first lieutenant and saw action on the Western Front. A pin-up model (known as a pin-up girl for a female and less commonly male pin-up for a male) is a model whose mass-produced pictures see widespread appeal as part of popular culture. Pin-up models were variously glamour models, fashion models, or actresses whose pictures were intended for informal display, i.e. meant to be "''pinned-up''" on a wall, which is the basis for the etymology of the phrase. These pictures are also sometimes known as cheesecake photos.
