Genocidal Rape
Genocidal rape, a form of wartime sexual violence, is the action of a group which has carried out acts of mass rape and gang rapes, against its enemy during wartime as part of a genocide, genocidal campaign. During the Armenian genocide, Armenian Genocide, the Nanjing massacre, second Sino-Japanese war, the Holocaust, the Bangladesh Liberation War, the Bosnian War, the Rwandan genocide, the Sexual violence in the Democratic Republic of the Congo, Congolese conflicts, the Genocide of Yazidis by ISIL, Iraqi Civil War, the South Sudanese Civil War, the Rohingya genocide, the mass rapes that had been an integral part of those conflicts brought the concept of genocidal rape to international prominence. Wartime Sexual Violence
Wartime sexual violence is rape or other forms of sexual violence committed by combatants during armed conflict, war, or military occupation often as spoils of war, but sometimes, particularly in ethnic conflict, the phenomenon has broader sociological motives. Wartime sexual violence may also include gang rape and rape with objects. A war crime, it is distinguished from sexual harassment, sexual assaults and rape committed amongst troops in military service. During war and armed conflict, rape is frequently used as a means of psychological warfare in order to humiliate the enemy. Genocidal Intent
Genocidal intent is the ''mens rea'' for the crime of genocide. "Intent to destroy" is one of the elements of the crime of genocide according to the 1948 Genocide Convention. There are some analytic differences between the concept of intent under national criminal law, where responsibility for a murder is ascribed to an individual based on their mental state, and international law. Under international law, responsibility falls upon individuals in their capacities as members of certain organizations or other official roles. The intent for genocide is less direct. An international court might look at whether the defendant participated in planning the genocidal acts, perhaps within the auspices of a certain organizational structure, or whether they acted with knowledge of such a preconceived plan. Rape During The Darfur Genocide
Throughout the ongoing Darfur genocide in the Darfur war there has been a systematic campaign of rape, which has been used as a war rape, weapon of war, in the ethnic cleansing of black Africans from the region. The majority of rapes have been carried out by the Sudanese government forces and the Janjaweed ("evil men on horseback") paramilitary groups. The actions of the Janjaweed have been described as genocidal rape, with not just women, but children also being raped, as well as babies being bludgeoned to death and the sexual mutilation of victims being commonplace. Janjaweed
The Janjaweed ( ar, جنجويد, Janjawīd, lit=mounted gunman; also transliterated ''Janjawid'') are a Sudanese Arab militia group that operate in Sudan, particularly Darfur, and eastern Chad. Using the United Nations definition, the Janjaweed comprise Sudanese Arab tribes, the core of whom are from the Abbala ( camel herder) background with significant recruitment from the Baggara (cattle herder) people. This UN definition may not necessarily be accurate, as instances of members from other tribes have been noted. The War in Darfur, also nicknamed the Land Cruiser War, is a major armed conflict in the Darfur region of Sudan that began in February 2003 when the Sudan Liberation Movement (SLM) and the Justice and Equality Movement (JEM) rebel groups began fighting against the government of Sudan, which they accused of oppressing Darfur's non-Arab population. Ethnic Cleansing
Ethnic cleansing is the systematic forced removal of ethnic, racial, and religious groups from a given area, with the intent of making a region ethnically homogeneous. Along with direct removal, extermination, deportation or population transfer, it also includes indirect methods aimed at forced migration by coercing the victim group to flee and preventing its return, such as murder, rape, and property destruction. It constitutes a crime against humanity and may also fall under the Genocide Convention, even as ''ethnic cleansing'' has no legal definition under international criminal law. Rape During The Sierra Leone Civil War
During the Sierra Leone Civil War gender specific violence was widespread. Rape, sexual slavery and forced marriages were commonplace during the conflict. It has been estimated by Physicians for Human Rights (PHR) that up to 257,000 women were victims of gender related violence during the war. The majority of assaults were carried out by the Revolutionary United Front (RUF). The Armed Forces Revolutionary Council (AFRC), The Civil Defence Forces (CDF), and the Sierra Leone Army (SLA) have also been implicated in sexual violence.
