''General Dynamics Corp. v. United States'', 563 U.S. 478 (2011), is a U.S. Supreme Court case in which the State Secrets Privilege prevented the plaintiff from using the evidence it needed to protect itself from an expensive judgement. Background In 1988 the U.S. Navy ordered a new stealth aircraft, the A-12 Avenger, to be built by contractors General Dynamics and McDonnell Douglas. The United States government classification system is established under Executive Order 13526, the latest in a long series of executive orders on the topic beginning in 1951. Issued by President Barack Obama in 2009, Executive Order 13526 replaced earlier executive orders on the topic and modified the regulations codified to 32 C.F.R. 2001. It lays out the system of classification, declassification, and handling of national security information generated by the U.S. government and its employees and contractors, as well as information received from other governments. The desired degree of secrecy about such information is known as its sensitivity. Sensitivity is based upon a calculation of the damage to national security that the release of the information would cause. Declassification
Declassification is the process of ceasing a protective classification, often under the principle of freedom of information. Procedures for declassification vary by country. Papers may be withheld without being classified as secret, and eventually made available. United Kingdom Classified information has been governed by various Official Secrets Acts, the latest being the Official Secrets Act 1989. Until 1989 requested information was routinely kept secret invoking the public interest defence; this was largely removed by the 1989 Act. The Freedom of Information Act 2000 largely requires information to be disclosed unless there are good reasons for secrecy.
