Fox Film Corp. V. Muller
''Fox Film Corp. v. Muller'', 296 U.S. 207 (1935), was a case in which the Supreme Court of the United States held that it cannot exert certiorari jurisdiction over a case in which there is an adequate and independent state law ground for the state court's final judgment.. Facts Plaintiff Fox Film Corporation sued defendant Muller in the state trial court of Minnesota, alleging that Muller had breach of contract, breached two contracts to exhibit the company's motion pictures. Muller's defense was that the contract was invalid under the Sherman Antitrust Act. The trial court found for Muller, first determining that the contract was invalid under the Sherman Act. The Minnesota Supreme Court affirmed, and the plaintiffs petitioned the U.S. Supreme Court for certiorari. Sherman Antitrust Act
The Sherman Antitrust Act of 1890 (, ) is a United States antitrust law which prescribes the rule of free competition among those engaged in commerce. It was passed by Congress and is named for Senator John Sherman, its principal author. The Sherman Act broadly prohibits 1) anticompetitive agreements and 2) unilateral conduct that monopolizes or attempts to monopolize the relevant market. The Act authorizes the Department of Justice to bring suits to enjoin (i.e. prohibit) conduct violating the Act, and additionally authorizes private parties injured by conduct violating the Act to bring suits for treble damages (i.e. three times as much money in damages as the violation cost them). Over time, the federal courts have developed a body of law under the Sherman Act making certain types of anticompetitive conduct per se illegal, and subjecting other types of conduct to case-by-case analysis regarding whether the conduct unreasonably restrains trade. This is a list of cases reported in volume 296 of ''United States Reports'', decided by the Supreme Court of the United States in 1935 and 1936. Justices of the Supreme Court at the time of volume 296 U.S. The Supreme Court is established by Article III, Section 1 of the Constitution of the United States, which says: "The judicial Power of the United States, shall be vested in one supreme Court . . .". The size of the Court is not specified; the Constitution leaves it to Congress to set the number of justices. George Sutherland
George Alexander Sutherland (March 25, 1862July 18, 1942) was an English-born American jurist and politician. He served as an associate justice of the U.S. Supreme Court between 1922 and 1938. As a member of the Republican Party, he also represented Utah in both houses of Congress. Born in Buckinghamshire, England, Sutherland and his family moved to the Utah Territory in the 1860s. After attending the University of Michigan Law School, Sutherland established a legal practice in Provo, Utah, and won election to the Utah State Senate. Sutherland won election to the United States House of Representatives in 1900 and to the United States Senate in 1905. In Congress, Sutherland supported several progressive policies but generally aligned with the party's conservative wing. He won re-election in 1911 but was defeated in the 1916 election by Democrat William H. King. Severability
In law, severability (sometimes known as salvatorius, from Latin) refers to a provision in a contract or piece of legislation which states that if some of the terms are held to be illegal or otherwise unenforceable, the remainder should still apply. Sometimes, severability clauses will state that some provisions to the contract are so essential to the contract's purpose that if they are illegal or unenforceable, the contract as a whole will be voided. However, in many legal jurisdictions, a severability clause will not be applied if it changes the fundamental nature of the contract, and that instead the contract will be void; thus, often this is not explicitly stated in the severability clause. Arbitration Clause
An arbitration clause is a clause in a contract that requires the parties to resolve their disputes through an arbitration process. Although such a clause may or may not specify that arbitration occur within a specific jurisdiction, it always binds the parties to a type of resolution outside the courts, and is therefore considered a kind of forum selection clause. Arbitration clauses are frequently paired with class action waivers which prevents contracting parties to file class action lawsuits against each other. In the United States, arbitration clauses also include a provision which requires parties to waive their rights to a jury trial.
