Felix Moncla
First Lieutenant#United States, First Lieutenant Felix Eugene Moncla Jr. (October 21, 1926 – Presumption of death, presumed dead November 23, 1953) was a United States Air Force (USAF) pilot who disappeared while performing an air defense intercept over Lake Superior in 1953. Moncla's disappearance is sometimes known as the Kinross Incident, after Kinross Air Force Base, where Moncla was on temporary assignment when he disappeared. The USAF reported that Moncla had crashed into Lake Superior while tracking a Royal Canadian Air Force (RCAF) C-47 aircraft which was off course. According to the report, the pilot of the Canadian aircraft did not know that he was the subject of an interception. Declared Death In Absentia
A presumption of death occurs when a person is thought to be dead by a group of people despite the absence of direct proof of the person's death, such as the finding of remains (e.g., a corpse or skeleton) attributable to that person. Such a presumption is typically made by an individual when a person has been missing for an extended period and in the absence of any evidence that person is still alive – or after a much shorter period, but where the circumstances surrounding a person's disappearance overwhelmingly support the belief that the person is dead (e.g., an airplane crash). A declaration that a person is dead resembles other forms of "preventive adjudication", such as the declaratory judgment. Different jurisdictions have different legal standards for obtaining such a declaration and in some jurisdictions a presumption of death may arise after a person has been missing under certain circumstances and a certain amount of time.
