Elder Abuse Prevention And Prosecution Act Of 2017
On October 18. 2017, President Trump signed into law the Elder Abuse Prevention and Prosecution Act of 2017 (P.L. 115–70), identifying the need for data on elder abuse. An elder abuse case has many stages from the incident through investigation (by adult protective services or law enforcement), prosecution, and trauma recovery. Several federal agencies currently collect elder abuse data (including physical abuse, neglect, and financial exploitation) on an ongoing basis at different points in the process. The Act increases the federal government's focus on preventing elder abuse and exploitation by creating a multi-pronged approach for protecting older adults by punishing perpetrators who exploit, abuse, and harm vulnerable seniors. Elder abuse (also called "elder mistreatment", "senior abuse", "abuse in later life", "abuse of older adults", "abuse of older women", and "abuse of older men") is "a single, or repeated act, or lack of appropriate action, occurring within any relationship where there is an expectation of trust, which causes harm or distress to an older person." This definition has been adopted by of the World Health Organization (WHO) from a definition put forward by Hourglass (formerly Action on Elder Abuse) in the UK. Laws protecting the elderly from abuse are similar to and related to laws protecting dependent adults from abuse. Adult Protective Services
In the United States, Adult Protective Services (APS) are social services provided to abused, neglected, or exploited older adults and adults with significant disabilities. APS is typically administered by local or state health, aging, or regulatory departments and includes a multidisciplinary approach to helping older adults, and younger adults with disabilities, who are victims. Services range from the initial investigation of mistreatment, to health and supportive services and legal interventions, up to and including the appointment of surrogate decision-makers such as legal guardians. While some states provide adult protective services to older adults only, as in Ohio where the APS law applies to those 60 and older, most serve adults with disabilities over the age of 18 who meet the state's definition of "vulnerable". National Incident-Based Reporting System
National Incident-Based Reporting System (NIBRS) is an incident-based reporting system used by law enforcement agencies in the United States for collecting and reporting data on crimes. Local, state and federal agencies generate NIBRS data from their records management systems. Data is collected on every incident and arrest in the Group A offense category. These Group A offenses are 52 offenses grouped in 23 crime categories. Specific facts about these offenses are gathered and reported to NIBRS. A vulnerable adult is defined as an individual age 18 or older who has the functional, mental, or physical inability to care for themselves. It can also refer to one who is unable to protect themselves against significant harm or exploitation. A vulnerable adult is one that has a substantial mental or functional impairment. A vulnerable adult, due to the reasons listed previously, may also require specific care from community resources. Substantial functional impairment is an inability referring to physical limitations. Substantial mental impairment is a disorder of mood, thought, perception, memory, or orientation. This grossly impairs the person's judgement, behavior, or ability to be independent.
