Davis V. United States (1994)
''Davis v. United States'', 512 U.S. 452 (1994), was a United States Supreme Court case in which the Court established that the right to counsel can only be legally asserted by an "unambiguous or unequivocal request for counsel." Background A bloodstain on one of the pool cues in the recreation hall led Naval Investigative Service (NIS) agents to Robert L. Davis.''Davis v. United States'', . During questioning, Davis said, “Maybe I should talk to a lawyer.” When asked by the interviewers to clarify his ambiguous request, Davis responded that he did not want counsel. After his conviction of murder, Davis tried to appeal, claiming that his right to counsel was declined. However, his conviction was affirmed when his request for counsel was reviewed, deemed ambiguous, and it was concluded that the NIS indeed clarify his intentions before continuing with questioning. Fifth Amendment To The United States Constitution
The Fifth Amendment (Amendment V) to the United States Constitution addresses criminal procedure and other aspects of the Constitution. It was ratified, along with nine other articles, in 1791 as part of the Bill of Rights. The Fifth Amendment applies to every level of the government, including the federal, state, and local levels, in regard to a US citizen or resident of the US. The Supreme Court furthered the protections of this amendment through the Due Process Clause of the Fourteenth Amendment. One provision of the Fifth Amendment requires that felonies be tried only upon indictment by a grand jury. Another provision, the Double Jeopardy Clause, provides the right of defendants to be tried only once in federal court for the same offense. The self-incrimination clause provides various protections against self-incrimination, including the right of an individual not to serve as a witness in a criminal case in which they are the defendant. The Supreme Court of the United States (SCOTUS) is the highest court in the federal judiciary of the United States. It has ultimate appellate jurisdiction over all U.S. federal court cases, and over state court cases that involve a point of federal law. In criminal law, the right to counsel means a defendant has a legal right to have the assistance of counsel (i.e., lawyers) and, if the defendant cannot afford a lawyer, requires that the government appoint one or pay the defendant's legal expenses. The right to counsel is generally regarded as a constituent of the right to a fair trial. Historically, however, not all countries have always recognized the right to counsel. The right is often included in national constitutions. Of the 194 constitutions currently in force, 153 have language to this effect.
