Dominion Voting Systems V. Fox News Network
''Dominion Voting Systems v. Fox News Network'' (colloquially ''Dominion v. Fox'') was a U.S. defamation lawsuit filed in March 2021 by Dominion Voting Systems against Fox News Channel and its corporate parent Fox Corporation. Dominion's complaint sought US$1.6billion in damages, alleging several Fox programs had broadcast false statements that Dominion's voting machines had been rigged to steal the 2020 United States presidential election from then-president Donald Trump. Fox News argued that it was reporting "pure opinion" regarding what others were saying which, if true, would be protected by the First Amendment to the Constitution and ''New York Times Co. v. Sullivan'' (1964). Dominion focused on allegations made between November 2020 and January 2021 by hosts Maria Bartiromo, Tucker Carlson, Lou Dobbs, Sean Hannity, and Jeanine Pirro. Guests who often appeared with these hosts included Trump attorneys Rudy Giuliani and Sidney Powell, both of whom have also been ...

Opening Statement
An opening statement is generally the first occasion that the trier of fact (jury or judge) has to hear from a lawyer in a trial, aside possibly from questioning during voir dire. The opening statement is generally constructed to serve as a "road map" for the fact-finder. This is especially essential, in many jury trials, since jurors (at least theoretically) know nothing at all about the case before the trial, (or if they do, they are strictly instructed by the judge to put preconceived notions aside). Though such statements may be dramatic and vivid, they must be limited to the evidence reasonably expected to be presented during the trial. Attorneys generally conclude opening statements with a reminder that at the conclusion of evidence, the attorney will return to ask the fact-finder to find in his or her client's favor. Opening statements are, in theory, not allowed to be argumentative, or suggest the inferences that fact-finders should draw from the evidence they will hea ...

Actual Malice
Actual malice in United States law is a legal requirement imposed upon public officials or public figures when they file suit for libel (defamatory printed communications). Compared to other individuals who are less well known to the general public, public officials and public figures are held to a higher standard for what they must prove before they may succeed in a defamation lawsuit. History This term was adopted by the Supreme Court in its landmark 1964 ruling in ''New York Times Co. v. Sullivan'', in which the Warren Court held that: Although defined within the context of a media defendant, the rule requiring proof of actual malice applies to all defendants including individuals. The standard can make it very difficult to prevail in a defamation case, even when allegations made against a public figure are unfair or are proved to be false. Rather than being newly invented for the case, the term was a term from existing libel law. In many jurisdictions, proof of "actual malice ...

Discovery (law)
Discovery, in the law of common law jurisdictions, is a pre-trial procedure in a lawsuit in which each party, through the law of civil procedure, can obtain evidence from the other party or parties by means of discovery devices such as interrogatories, requests for production of documents, requests for admissions and depositions. Discovery can be obtained from non-parties using subpoenas. When a discovery request is objected to, the requesting party may seek the assistance of the court by filing a motion to compel discovery. History Discovery evolved out of a unique feature of early equitable pleading procedure before the English Court of Chancery: among various requirements, a plaintiff's bill in equity was required to plead "positions". These were statements of evidence that the plaintiff assumed to exist in support of his pleading and which he believed lay within the knowledge of the defendant. They strongly resembled modern requests for admissions, in that the defen ...
