Cariou V. Prince
''Cariou v. Prince'', 714 F.3d 694 (2d Cir. 2013) is a copyright case in the United States Court of Appeals for the Second Circuit, on the question of whether artist Richard Prince's appropriation art treatment of Patrick Cariou's photographs was a copyright infringement or a fair use. The Second Circuit held in 2013 that Prince's appropriation art ''could'' constitute fair use, and that a number of his works were transformative fair uses of Cariou's photographs. The Court remanded to the United States District Court for the Southern District of New York for reconsideration of five of Prince's works. Appropriation (art)
Appropriation in art is the use of pre-existing objects or images with little or no transformation applied to them. The use of appropriation has played a significant role in the history of the arts (literary, visual, musical and performing arts). In the visual arts, to appropriate means to properly adopt, borrow, recycle or sample aspects (or the entire form) of human-made visual culture. Notable in this respect are the Readymades of Marcel Duchamp. Inherent in the understanding of appropriation is the concept that the new work recontextualizes whatever it borrows to create the new work. In most cases, the original "thing" remains accessible as the original, without change. Bernard Harvey (born August 17, 1985), known professionally as Harv, is an American record producer, musician and songwriter from Kansas City, Kansas and based in Los Angeles, who has produced acclaimed work for major recording artists such as Justin Bieber, Skrillex, Cherish (group), Cherish, Summer Walker, Normani, Post Malone, Gucci Mane, Eminem and Omah Lay. Milton Ernest "Robert" Rauschenberg (October 22, 1925 – May 12, 2008) was an American painter and graphic artist whose early works anticipated the Pop art movement. Rauschenberg is well known for his Combines (1954–1964), a group of artworks which incorporated everyday objects as art materials and which blurred the distinctions between painting and sculpture. Rauschenberg was both a painter and a sculptor, but he also worked with photography, printmaking, papermaking and performance. Rauschenberg received numerous awards during his nearly 60-year artistic career. Among the most prominent were the International Grand Prize in Painting at the 32nd Venice Biennale in 1964 and the National Medal of Arts in 1993.
