Canon 1397 §2 is a paragraph of the canon 1397 of the 1983 ''Code of Canon Law'' of the Catholic Church; the paragraph states: "A person who actually procures an abortion incurs a ''latae sententiae'' excommunication". Previous numbering Before the December 2021 reform, the canon 1398 of the 1983 ''Code of Canon Law'' of the Catholic Church stated: "A person who procures a completed abortion incurs a latae sententiae excommunication". Due to the reform, the legislation was renumbered as canon 1397 §2 and its wording was changed. Canon (canon Law)
In canon law, a canon designates some law promulgated by a synod, an ecumenical council, or an individual bishop. The word "canon" comes from the Greek ''kanon'', which in its original usage denoted a straight rod that was later the instrument used by architects and artificers as a measuring stick for making straight lines. ''Kanon'' eventually came to mean a rule or norm, so that when the first ecumenical council—Nicaea I—was held in 325, ''kanon'' started to obtain the restricted juridical denotation of a law promulgated by a synod or ecumenical council, as well as that of an individual bishop. In the canon law of the Catholic Church, excommunication (Lat. ''ex'', "out of", and ''communio'' or ''communicatio'', "communion"; literally meaning "exclusion from communion") is a form of censure. In the formal sense of the term, excommunication includes being barred not only from the sacraments but also from the fellowship of Christian baptism. The principal and severest censure, excommunication presupposes guilt; and being the most serious penalty that the Catholic Church can inflict, it supposes a grave offense.
