City Of Cleburne V. Cleburne Living Center, Inc.
''City of Cleburne v. Cleburne Living Center, Inc.'', 473 U.S. 432 (1985), was a U.S. Supreme Court case involving discrimination against the intellectually disabled. In 1980, Cleburne Living Center, Inc. (CLC) submitted a permit application seeking approval to build a group home for intellectually disabled people. The city of Cleburne, Texas refused to grant CLC a permit on the basis of a municipal zoning ordinance. CLC then sued the City of Cleburne on the theory that the denial of the permit violated the Fourteenth Amendment Equal Protection rights of CLC and their potential residents. Applying rational basis review, the U.S. Supreme Court struck down the ordinance as applied to CLC. The Court declined to rule that intellectually disabled people were a quasi-suspect or suspect class. Background In July 1980, Jan Hannah purchased a building at 201 Featherston Street, within the city limits of Cleburne, with the intent of leasing it to CLC so that they could operate it as ...

Fourteenth Amendment To The United States Constitution
The Fourteenth Amendment (Amendment XIV) to the United States Constitution was adopted on July 9, 1868, as one of the Reconstruction Amendments. Often considered as one of the most consequential amendments, it addresses citizenship rights and equal protection under the law and was proposed in response to issues related to former slaves following the American Civil War. The amendment was bitterly contested, particularly by the states of the defeated Confederacy, which were forced to ratify it in order to regain representation in Congress. The amendment, particularly its first section, is one of the most litigated parts of the Constitution, forming the basis for landmark Supreme Court decisions such as ''Brown v. Board of Education'' (1954) regarding racial segregation, ''Roe v. Wade'' (1973) regarding abortion ( overturned in 2022), ''Bush v. Gore'' (2000) regarding the 2000 presidential election, and ''Obergefell v. Hodges'' (2015) regarding same-sex marriage. The amendment ...

Romer V
A Reference Card or "Romer" is a device for increasing the accuracy when reading a grid reference from a map. Made from transparent plastic, paper or other materials, they are also found on most baseplate compasses. Essentially, it is a specially marked-out ruler which matches the scale of the map in use. The scales are laid out in reverse, such that by lining up the numbers given in the grid reference with the gridlines for the square in question, the corner of the Romer lies on the location whose grid reference you wish to read. Some transparent versions have a small hole at the origin when this is not at the corner of the Reference Card. This allows access to the map such that the location could be marked with a pencil if using the Reference Card in reverse having been given a grid reference to start with. They are used in many types of land navigation and map reading, to give a more accurate grid reference than one just estimated by eye from the grid lines on the map. While R ...

Rational Basis Level Of Review
In U.S. constitutional law, rational basis review is the normal standard of review that courts apply when considering constitutional questions, including due process or equal protection questions under the Fifth Amendment or Fourteenth Amendment. Courts applying rational basis review seek to determine whether a law is "rationally related" to a "legitimate" government interest, whether real or hypothetical."Rational Basis Test"

Equal Protection Clause
The Equal Protection Clause is part of the first section of the Fourteenth Amendment to the United States Constitution. The clause, which took effect in 1868, provides "''nor shall any State ... deny to any person within its jurisdiction the equal protection of the laws.''" It mandates that individuals in similar situations be treated equally by the law. A primary motivation for this clause was to validate the equality provisions contained in the Civil Rights Act of 1866, which guaranteed that all citizens would have the guaranteed right to equal protection by law. As a whole, the Fourteenth Amendment marked a large shift in American constitutionalism, by applying substantially more constitutional restrictions against the states than had applied before the American Civil War, Civil War. The meaning of the Equal Protection Clause has been the subject of much debate, and inspired the well-known phrase "Equal justice under law, Equal Justice Under Law". This clause was the basis for ...
