Benefits Review Board
The Department of Labor's Benefits Review Board was created in 1972, by the United States Congress, to review and issue decisions on appeals of workers’ compensation claims arising under the Longshore and Harbor Workers’ Compensation Act and the Black Lung Benefits amendments to the Federal Coal Mine Health and Safety Act of 1969. Operation The Board, by statute, consists of five Members appointed by the Secretary of Labor, one of whom is designated as Chairman and Chief Administrative Appeals Judge. The Board's mission is to issue decisions on the appeals pending before it with expediency, consistency and impartiality, in accordance with its statutory standard of review and applicable law. The Board exercises the appellate review authority formerly exercised by the United States District Courts. Longshore And Harbor Workers’ Compensation Act
The Longshore and Harbor Workers' Compensation Act, , commonly referred to as the "Longshore Act" or "LHWCA" is federal workers' compensation law/act enacted in 1927. Initially, it mandated coverage to employees injured on navigable waters of the United States. Today, it mandates that coverage be provided to certain "maritime" workers, including most dock workers and maritime workers not otherwise covered by the Jones Act. Federal Coal Mine Health And Safety Act
The Federal Coal Mine Health and Safety Act of 1969, U.S. Public Law 91-173, generally referred to as the Coal Act, was passed by the 91st United States Congressional session and enacted into law by the 37th President of the United States Richard Nixon on December 30, 1969. The S. 2917 legislation created the Mining Enforcement and Safety Administration (MESA), later renamed the Mine Safety and Health Administration (MSHA), as well as a National Mine Map Repository, within the Department of the Interior. MSHAs responsibilities paralleled those of Occupational Safety and Health Administration (OSHA) but addressed underground and surface mining of coal.
