All Rights Reserved
"All rights reserved" is a copyright formality indicating that the copyright holder ''reserves'', or holds for its own use, all the rights provided by copyright law. Originating in the Buenos Aires Convention of 1910, it is unclear if it has any legal effect in any jurisdiction. However, it is still used by many copyright holders. Origins The phrase originated as a result of the Buenos Aires Convention of 1910. Article 3 of the Convention granted copyright in all signatory countries to a work registered in any signatory country, as long as a statement "that indicates the ''reservation'' of the property ''right''" (emphasis added) appeared in the work. The phrase "all rights reserved" was not specified in the text, but met this requirement. Other copyright treaties did not require this formality. For example, in 1952 the Universal Copyright Convention (UCC) adopted the Copyright symbol, © symbol as an indicator of protection. (The symbol was introduced in the US by a 1954 amend ...

Copyright
A copyright is a type of intellectual property that gives its owner the exclusive right to copy, distribute, adapt, display, and perform a creative work, usually for a limited time. The creative work may be in a literary, artistic, educational, or musical form. Copyright is intended to protect the original expression of an idea in the form of a creative work, but not the idea itself. A copyright is subject to limitations based on public interest considerations, such as the fair use doctrine in the United States. Some jurisdictions require "fixing" copyrighted works in a tangible form. It is often shared among multiple authors, each of whom holds a set of rights to use or license the work, and who are commonly referred to as rights holders. These rights frequently include reproduction, control over derivative works, distribution, public performance, and moral rights such as attribution. Copyrights can be granted by public law and are in that case considered "territorial righ ...

Buenos Aires Convention
The Buenos Aires Convention (Third Pan-American Convention) is an international copyright treaty signed in Buenos Aires, Argentina, on 11 August 1910, providing mutual recognition of copyrights where the work carries a notice containing a statement of reservation of rights (Art. 3). This was commonly done with the phrase "All rights reserved" ( es, Todos los derechos reservados; pt, Todos os direitos reservados) next to the copyright notice. This implementation varied as US law only required the author and year of publishing. Copyright protection under the convention is granted for the shorter of the terms of the protecting country and the source country of the work ("rule of the shorter term", Arts. 6, 7). The rather vague nature of the requirement for a statement of reservation led to the development of longer and more legalistic wordings, which have persisted despite the developments in international copyright law. The convention is specifically retained by the Un ...

Universal Copyright Convention
The Universal Copyright Convention (UCC), adopted in Geneva, Switzerland, in 1952, is one of the two principal international conventions protecting copyright; the other is the Berne Convention. The UCC was developed by the United Nations Educational, Scientific and Cultural Organization (UNESCO) as an alternative to the Berne Convention for those states that disagreed with aspects of the Berne Convention but still wished to participate in some form of multilateral copyright protection. These states included developing countries as well as the United States and most of Latin America. The developing countries thought that the strong copyright protections granted by the Berne Convention overly benefited Western, developed, copyright-exporting nations; whereas the United States and Latin America were already members of the Buenos Aires Convention, a Pan-American copyright convention that was weaker than the Berne Convention. The Berne Convention states also became party to the UCC, so ...

Copyright Symbol
The copyright symbol, or copyright sign, (a circled capital letter C for copyright), is the symbol used in copyright notices for works other than sound recordings.17 U.S.C. The use of the symbol is described by the Universal Copyright Convention. The symbol is widely recognized but, under the Berne Convention, is no longer required in most nations to assert a new copyright. US law In the United States, the Berne Convention Implementation Act of 1988, effective March 1, 1989, removed the requirement for the copyright symbol from U.S. copyright law, but its presence or absence is legally significant on works published before that date, and it continues to affect remedies available to a copyright holder whose work is infringed. History Prior symbols indicating a work's copyright status are seen in Scottish almanacs of the 1670s; books included a printed copy of the local coat-of-arms to indicate their authenticity. A copyright notice was first required in the U.S. by the Copy ...

Copyright Act Of 1909
The Copyright Act of 1909 () was a landmark statute in United States statutory copyright law. It went into effect on July 1, 1909. The 1909 Act was repealed and superseded by the Copyright Act of 1976, which went into effect on January 1, 1978; but some of 1909 Act's provisions continue to apply to copyrighted works created before 1978. It allowed for works to be copyrighted for a period of 28 years from the date of publication and extended the renewal term from 14 years (effective as of the Copyright Act of 1831) to 28 years, for a maximum of 56 years (in place of the former 42 years). Background Before the 1909 Act, the last major revision to United States copyright law was the 1790 Act. Methods of reproducing and duplicating works subject to copyright had significantly increased since the 1790 Act. President Theodore Roosevelt expressed the need for a complete revision of copyright law as opposed to amendments, saying in a message to Congress in December 1905, "Our copyrig ...

Berne Convention
The Berne Convention for the Protection of Literary and Artistic Works, usually known as the Berne Convention, was an international assembly held in 1886 in the Swiss city of Bern by ten European countries with the goal to agree on a set of legal principles for the protection of original work. They drafted and adopted a multi-party contract containing agreements for a uniform, crossing border system that became known under the same name. Its rules have been updated many times since then. The treaty provides authors, musicians, poets, painters, and other creators with the means to control how their works are used, by whom, and on what terms. In some jurisdictions these type of rights are being referred to as copyright. The United States became a party in 1989. As of November 2022, the Berne Convention has been ratified by 181 states out of 195 countries in the world, most of which are also parties to the Paris Act of 1971. The Berne Convention introduced the concept that prote ...

Copyright Formalities
Copyright formalities are legal (generally statutory) requirements needed to obtain a copyright in a particular jurisdiction. Common copyright formalities include copyright registration, copyright renewal, copyright notice, and copyright deposit. Benefits and critiques Copyright formalities had certain benefits to users and holders of copyrights. First, they made determination of copyright status fairly easy. Copyright notice requirements—such as placing a notice of copyright on the work itself, along with the copyright holder, and the date of copyright—meant that any work could readily be determined to be in copyright simply by looking for the copyright notice. Copyright registration and renewal requirements meant that records of copyright owners were centrally located and made available; this facilitated licensing arrangements, and contacting the holders. It also provided authoritative records about who owned the copyright, in case of disputes. However, copyright for ...

Copyright Notice
In United States copyright law, a copyright notice is a notice of statutorily prescribed form that informs users of the underlying claim to copyright ownership in a published work. Copyright is a form of protection provided by US law to authors of "original works of authorship". When a work is published under the authority of the copyright owner, a notice of copyright may be placed on all publicly distributed copies or phonorecords. The use of the notice is the responsibility of the copyright owner and does not require permission from, or registration with, the Copyright Office. Use of the notice informs the public that a work is protected by copyright, identifies the copyright owner, and shows the year of first publication. Furthermore, in the event that a work is infringed, if the work carries a proper notice, the court will not give any weight to a defendant's use of an innocent infringement defense—that is, to a claim that the defendant did not realize that the work was p ...

Creative Commons
Creative Commons (CC) is an American non-profit organization and international network devoted to educational access and expanding the range of creative works available for others to build upon legally and to share. The organization has released several copyright licenses, known as Creative Commons licenses, free of charge to the public. These licenses allow authors of creative works to communicate which rights they reserve and which rights they waive for the benefit of recipients or other creators. An easy-to-understand one-page explanation of rights, with associated visual symbols, explains the specifics of each Creative Commons license. Content owners still maintain their copyright, but Creative Commons licenses give standard releases that replace the individual negotiations for specific rights between copyright owner (licensor) and licensee, that are necessary under an "all rights reserved" copyright management. The organization was founded in 2001 by Lawrence Lessig, Hal ...
