1879 Mudgee Colonial By-election
A by-election was held for the New South Wales Legislative Assembly electorate of Mudgee on 6 January 1879 because of the resignation of Sir John Robertson who was then appointed to the Legislative Council, to facilitate the coalition of his supporters and those of Sir Henry Parkes to form an effective government. Dates Candidates * Richard Rouse was a former member for Mudgee, winning the 1876 by-election, before being defeated by Robertson at the 1877 election. * David Buchanan was a former member for Goldfields West, who had been defeated at the 1877 election. Results Sir John Robertson resigned to be appointed to the Legislative Council. Aftermath In March 1879 the Committee of Elections and Qualifications overturned the election of Richard Rouse and declared that David Buchanan was elected as the member for Mudgee. New South Wales Legislative Assembly
The New South Wales Legislative Assembly is the lower of the two houses of the Parliament of New South Wales, an Australian state. The upper house is the New South Wales Legislative Council. Both the Assembly and Council sit at Parliament House in the state capital, Sydney. The Assembly is presided over by the Speaker of the Legislative Assembly. The Assembly has 93 members, elected by single-member constituency, which are commonly known as seats. Voting is by the optional preferential system. Members of the Legislative Assembly have the post-nominals MP after their names. From the creation of the assembly up to about 1990, the post-nominals "MLA" (Member of the Legislative Assembly) were used. Results Of The 1877 New South Wales Colonial Election
The 1877 New South Wales colonial election was for 73 members representing 61 electoral districts. The election was conducted on the basis of a simple majority or first-past-the-post voting system. In this election there were 8 multi-member districts returning 20 members and 53 single member districts. In the multi-member districts each elector could vote for as many candidates as there were vacancies. 17 districts were uncontested. There was no recognisable party structure at this election. There were four districts that did not have a residential or property qualification, Goldfields North (1,200), Goldfields South (1,500), Goldfields West (10,000) and University of Sydney (158). The average number of enrolled voters per seat in the other districts was 2,342 ranging from The Paterson (556) to The Bogan (7,401). 1879 Mudgee Colonial Election Re-count
In March 1879 the Elections and Qualifications Committee overturned the 1879 Mudgee by-election, in which Richard Rouse had been declared elected by a margin of 1 vote over David Buchanan. The committee declared that Richard Rouse had not been elected the member for Mudgee, however no by-election was conducted. Instead the committee declared that David Buchanan had been elected. No reasons were published however The Sydney Morning Herald stated that it appeared that the majority of Mr Rouse was created by illegal voting. Petition Buchannan's supporters petitioned the Speaker of the Legislative Assembly against the return of Rouse, alleging that #The returning officer illegally voted in the election and voted for Rouse; #That a voter had left his vote for Rouse on the table and not placed it in the ballot box; #The Poll Clerk at one booth did not appear until 10:00 am despite voting commencing at 9:00 am; and #The electoral roll included two men under 21 years old who had vot ... David Buchanan (politician)
David Buchanan (1823 – 4 April 1890) was a barrister and politician in colonial New South Wales, a member of the New South Wales Legislative Assembly and later, the New South Wales Legislative Council. Buchanan was born in Edinburgh, Mid-Lothian, Scotland, the fifth son of William Buchanan, a barrister, and his wife Catherine, ''née'' Gregory. Buchanan was educated at the Edinburgh High School. Buchanan emigrated to Australia in 1852, and was elected to the New South Wales Legislative Assembly as member for Morpeth on 14 December 1860. In 1862 he unsuccessfully sued the Sydney Morning Herald for libel and was required to pay their legal costs. He was drunk in August 1862 and was involved in an altercation with Samuel Terry. In the assembly Buchanan described Terry as a coward, eventually withdrawing the remark. Buchanan continued to interrupt and held to be in contempt of parliament. Mudgee was an electoral district of the Legislative Assembly in the Australian state of New South Wales first created in 1859, partly replacing Wellington and Bligh and named after and including Mudgee. Following the abolition of Goldfields West in 1880, it elected three members simultaneously, with voters casting three votes and the three leading candidates being elected.
