1849 United States Senate Election In New York
The 1849 United States Senate election in New York was held on February 6, 1849, by the New York State Legislature to elect a U.S. Senator (Class 3) to represent the State of New York in the United States Senate. Background Barnburner John Adams Dix had been elected in 1845 to this seat after the resignation of Silas Wright, and Dix's term would expire on March 3, 1849. In November 1848, Dix was the Barnburners/Free-Soilers candidate for Governor of New York, but was defeated by Whig Hamilton Fish. At this time the Democratic Party in New York was split in two fiercely opposing factions: the "Barnburners" and the "Hunkers". The Barnburners organized the Free Soil Party in 1848 and nominated Martin Van Buren for U.S. President. Due to the split, the Whig Party won most of the elective offices by pluralities. William Seward
William Henry Seward (May 16, 1801 – October 10, 1872) was an American politician who served as United States Secretary of State from 1861 to 1869, and earlier served as governor of New York and as a United States Senator. A determined opponent of the spread of slavery in the years leading up to the American Civil War, he was a prominent figure in the Republican Party in its formative years, and was praised for his work on behalf of the Union as Secretary of State during the Civil War. He also negotiated the treaty for the United States to purchase the Alaskan Territory. Seward was born in 1801 in the village of Florida, in Orange County, New York, where his father was a farmer and owned slaves. The 72nd New York State Legislature, consisting of the New York State Senate and the New York State Assembly, met from January 2 to April 11, 1849, during the first year of Hamilton Fish's governorship, in Albany. Background Under the provisions of the New York Constitution of 1846, 32 Senators were elected in single-seat senatorial districts for a two-year term, the whole Senate being renewed biennially. The senatorial districts (except those in New York City) were made up of entire counties. 128 Assemblymen were elected in single-seat districts to a one-year term, the whole Assembly being renewed annually. James Davenport Whelpley
James Davenport Whelpley (1817–1872) was an American physician, author, editor, inventor, and metallurgist. Early life and education James Whelpley was born in New York City on January 23, 1817, the son of Rev. Philip Melanchthon Whelpley (December 22, 1794 – July 17, 1824) and his wife, Abigail Fitch Davenport (November 17, 1791 – June 1864). Philip Whelpley was, from May 1815 until his death, the pastor of the First Presbyterian Church, then situated on Wall Street in New York City. Abigail Whelpley was a descendant of Rev. David Rice Atchison
David Rice Atchison (August 11, 1807January 26, 1886) was a mid-19th century Democratic United States Senator from Missouri. He served as President pro tempore of the United States Senate for six years. Atchison served as a major general in the Missouri State Militia in 1838 during Missouri's Mormon War and as a Confederate brigadier general during the American Civil War under Major General Sterling Price in the Missouri Home Guard. He is best known for the claim that for 24 hours—Sunday, March 4, 1849 through noon on Monday—he may have been Acting President of the United States. The New York Court of Chancery was the highest court in the State of New York from 1701 to 1847. History The New York Court of Chancery was established during the British colonial administration on August 28, 1701, with the colonial governor acting as Chancellor. John Nanfan, the acting governor at the time, was therefore the first Chancellor. After the declaration of independence by the colonies during the American Revolutionary War, the newly established independent government created the New York State Constitution of 1777, which continued the court but required a lawyer to be appointed Chancellor.
